End User License Agreement

Please read this End User License Agreement ("Agreement" or "EULA") carefully before downloading, installing, or using the Better Coffee mobile application ("Application"). By using the Application, you agree to be bound by the terms of this Agreement.

1. License Grant

New Splash ("Licensor") grants you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application solely for your personal, non-commercial purposes on mobile devices owned or controlled by you, strictly in accordance with the terms of this Agreement.

2. Restrictions on Use

You agree not to, and you will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Application or make the Application available to any third party.
  • Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application.
  • Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Licensor or its affiliates, partners, or suppliers.

3. Intellectual Property

The Application, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights, is and shall remain the sole and exclusive property of Licensor (New Splash). Licensor is not obligated to indemnify or defend you with respect to any third-party claim arising out of or relating to the Application.

4. App Store Terms and Compliance

This Agreement is concluded solely between you and Licensor, and not with Apple Inc. or Google LLC. Licensor, not Apple or Google, is solely responsible for the Application and the content thereof. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

5. Premium Purchases & Subscriptions

The Application may offer a one-time "Lifetime Premium" purchase to unlock full ad-free usage and advanced specialty statistics. All purchases are handled securely through the respective store provider (Apple App Store or Google Play Store). Refunds, billing disputes, and payment processing are subject to the terms and conditions of the respective App Store provider.

6. Privacy and Data Handling

Better Coffee is designed to protect your privacy. All coffee brewing logs, recipes, grind settings, and statistics are stored locally on your device's offline database. No personal brewing logs or data are transmitted to external servers. For further information, please read our Privacy Policy.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Licensor be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, or business interruption) arising out of or in any way related to the use of or inability to use the Application.

8. Termination

This Agreement shall remain in effect until terminated by you or Licensor. Licensor may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

9. Governing Law

The laws of your jurisdiction, excluding its conflicts of law rules, shall govern this Agreement and your use of the Application. Your use of the Application may also be subject to other local, state, national, or international laws.
